TERMS AND CONDITIONS

Medal Paints (Pty) Limited (“Medal Paints”) is a well-established and reputable company that has been manufacturing a wide range of high-quality paints, protective surface coatings and allied products for over 40 years. Medal Paints is an ISO 9001: 2015 registered company. Medal Paints provides the following product guarantee on the below products sold under the MEDAL trademark. The following terms and conditions shall apply to the guarantee:

1. TERM

2. PRODUCT APPLICATION
2.1 The product has been applied and used in accordance with the instructions provided by Medal Paints, which instructions are contained on the product container and/or in Product Data Sheets displayed in-store or on Medal Paints’ website – www.medalpaints.co.za. Product Data Sheets define the intended use, product benefits, surface preparation, method of application and precautions that apply to the use of the product.;
2.2 The consumer has used the products prescribed by Medal Paints, such as primers, undercoats and top coats.

This guarantee shall only be applicable where:

3. VALUE OF PRODUCTS PURCHASED

3.1 The total value of the invoice relating to the purchase of the Product/s does not exceed R40 000 (forty thousand Rand) inclusive of VAT.

4. DETAILS OF PURCHASE AND GUARANTEE REGISTRATION
4.1 This product guarantee will only apply to products purchased in South Africa, BOTSWANA, NAMIBIA, LESOTHO, ZIMBABWE AND ZAMBIA (AND OTHER RELEVANT COUNTRIES).
4.2 This product guarantee will not be valid unless a purchaser has registered the warranty online at www.medalpaints.co.za or through Medal Paints’ Customer Service line (08600- 63325) within 30 (thirty) days of such products having been purchased.
4.3 The Term of the product will commence with effect from the date of purchase of the product and calculated, accordingly.
4.4 Purchasers are cautioned to retain their invoices, as same will be required as proof of purchase during the registration of the product guarantee. No product guarantee will be registered without proof of purchase.

5. NATURE OF PRODUCT FAILURE

5.1 Is limited to instances where the product cracks, blisters or where there is an adhesion failure, as defined and specified by the ISO standards applicable at the day of purchase;
5.2 Shall not apply where existing paints/ surface coatings to which the product is applied has adhesion or inter-coated adhesion failure;
5.3 Shall not apply where product failures arise from events or causes beyond the control of Medal Paint, which may include, product failure arising from pollution, mechanical damage, wear and tear, electrical or electrolyte damage, incorrect cleaning methods, vandalism or other malicious acts or where moisture levels exceeds industry standards.

6. CLAIM AND REPLACEMENT PROCEDURE
6.1 Any claim submitted in terms of this product guarantee shall not be valid unless:
6.1.1 A claim is submitted by the consumer with Medal Paints within 30 (thirty) days of the consumer discovering the defect, damage or failure which gives rise to the claim and the consumer refraining from removing, repairing and altering the area to which the claim extend, in any way.
6.1.2 The claim provides comprehensive information regarding the:
6.1.2.1 The date of the application of the products to which the claim extend;
6.1.2.2 A comprehensive description of the method of application of the products to which the claim extend, which shall include details of products used, method of preparation and precautions taken; and
6.1.2.3 Where reasonably possible, the claim should include photographs evidencing the nature of the alleged defect, failure of damage.
6.2 Medal Paints undertakes to, within 10 (ten) days of receipt of the claim, instruct a technical consultant to, personally, investigate and follow up on complaint.
6.3 The technical consultant shall be entitled to:
6.3.1 perform any test, reasonably required, either itself or by means of a nominated person, to determine if there was any product failure, damage or defect; and
6.3.2 request the consumers to provide it with such information as Medal paints may, reasonably, require, to consider, evaluate and process the claim.
6.4 Medal Paints will endeavour to process and finalise the complaint as soon as, reasonably, possible in the circumstances.
6.5 In the event of a successful claim in terms of this product guarantee, Medal Paint’s sole obligation, at its sole discretion, is to, at its sole expense, is to provide the consumer with a replacement product, of no lessor quality and to assume responsibility of all reasonable labour charges resulting from a re-application of the product complained of.
6.6 The above, constitutes the consumer’s exclusive remedy resulting from a breach of the quality guarantee.
6.7 The liability of Medal Paints in terms of this product guarantee and the obligations resulting from a breach of the guarantee to replace the product free of charge shall be reduced over the Term as follows:

3 year Term:
6.7.1.1 During first year: Full replacement value to be paid by Medal Paints

6.7.1.2 During second year: 67.6% of replacement value to be paid by Medal Paints
6.7.1.3 During third year: 33.3% of replacement value to be paid by Medal Paints

5 year Term:
6.7.2.1 During first year: Full replacement value to be paid by Medal Paints
6.7.2.2 During second year: 80% of replacement value to be paid by Medal Paints
6.7.2.3 During third year: 60% of replacement value to be paid by Medal Paints
6.7.2.4 During fourth year: 40% of replacement value to be paid by Medal Paints
6.7.2.5 During fifth year: 20% of replacement value to be paid by Medal Paints

7 year Term:
6.7.3.1 During first year: Full replacement value to be paid by Medal Paints
6.7.3.2 During second year: 85.7% of replacement value to be paid by Medal Paints
6.7.3.3 During third year: 71.4% of replacement value to be paid by Medal Paints
6.7.3.4 During fourth year: 57.1% of replacement value to be paid by Medal Paints
6.7.3.5 During fifth year: 42.8% of replacement value to be paid by Medal Paints
6.7.3.6 During sixth year: 28.5 % of replacement value to be paid by Medal Paints
6.7.3.7 During seventh year: 14.3% of replacement value to be paid by Medal Paints

8 year Term:
6.7.4.1 During first year: Full replacement value to be paid by Medal Paints
6.7.4.2 During second year: 85.7% of replacement value to be paid by Medal Paints
6.7.4.3 During third year: 71.4% of replacement value to be paid by Medal Paints
6.7.4.4 During fourth year: 57.1% of replacement value to be paid by Medal Paints
6.7.4.5 During fifth year: 42.8% of replacement value to be paid by Medal Paints
6.7.4.6 During sixth year: 28.5% of replacement value to be paid by Medal Paints
6.7.4.7 During seventh year: 14.3% of replacement value to be paid by Medal Paints
6.7.4.8 During eighth year: 10% of replacement value to be paid by Medal Paints

10 year Term:
6.7.4.1 During first year: Full replacement value to be paid by Medal Paints
6.7.5.2 During second year: 90% of replacement value to be paid by Medal Paints
6.7.5.3 During third year: 80% of replacement value to be paid by Medal Paints
6.7.4.4 During fourth year: 70% of replacement value to be paid by Medal Paints
6.7.4.5 During fifth year: 60% of replacement value to be paid by Medal Paints
6.7.4.6 During sixth year: 50 % of replacement value to be paid by Medal Paints
6.7.4.7 During seventh year: 40% of replacement value to be paid by Medal Paints
6.7.5.8 During eighth year: 30% of replacement value to be paid by Medal Paints
6.7.4.9 During ninth year: 20 % of replacement value to be paid by Medal Paints
6.7.4.10 During tenth year: 10% of replacement value to be paid by Medal Paints.

6.8 The above reductions shall apply pro rata to all labour costs reasonably incurred.
6.9 All costs other than the above shall be for the exclusive account of the consumer.
6.10 Medal Paints shall not be liable for any indirect or consequential loss or damages resulting from the use of the products or any compensation and or damages resulting from product failure or defect after the expiration of this product guarantee.

7. GENERAL

7.1 This product guarantee will only apply to instances where the total value of a single product purchased, to which this guarantee applies, does not exceed R40,000.00 (inclusive of VAT).

7.2 The term of this product guarantee will not be interrupted in the event of a successful product guarantee claim. A new product guarantee will come into effect only in instances where a total repaint is required, to the extent that such repaint complies with the stipulations contained in the relevant Product Data Sheets.
7.3 This product guarantee may be transferred by giving Medal Paints telephonic notice, through its above Customer Service line.
7.4 This product guarantee is no intended to limit either party’s remedies in contravention of any applicable law in South Africa.
